LA RESPONSABILIDAD SIN CULPA EN EL VOCABULARIO DE LOS JURISTAS ROMANOS CLÁSICOS

Resumen

RESUMEN: El presente artículo tiene por objeto el estudio de los usos linguísticos empleados por los juristas clásicos para denotar la existencia e inexistencia de responsabilidad. Corroborada la ausencia en latín clásico de la voz responsabilitas el análisis se centra en el empleo de los verbos tenere, praestare y debere, en especial, para determinar la imputación de responsabilidad en diversas hipótesis de ausencia de culpa, describiendo el uso de la expresión sine culpa en un sentido incluyente y otro excluyente. Con base en lo anterior, se propone el empleo preferente de la categoría y denominación “responsabilidad sin culpa” y el abandono de la expresión “responsabilidad objetiva” por no resultar adecuado para la descripción del fenómeno según nos es informado por las fuentes históricas.

ABSTRACT: The purpose of this paper is to study the linguistic uses the classical jurists employed to signal the existence or inexistence of liability. Corroborated the absence of the word responsabilitas in the classic Latin, the analysis focused on the uses given to the verbs tenere, praestare and debere, in particular, to determine the liability attribution on various hypothesis of not at fault events, describing the use of the term sine culpa in an inclusive and an exclusive way. Based on the above, we propose the preferred use of the category and denomination “liability without fault”, and to dismiss the use of the term “Strict liability”, since it is not suited to describe the phenomenon as informed by the historical sources.
